The Dutch Council of State ruled on 17 January in a higher appeal case that the temporary protection for non-Ukrainians fleeing from Ukraine, didn’t end on 4 September 2023, but will end on 4 March 2024.
For pending appeal procedures at the District Courts this means that Courts will probably annul the previous IND decisions ending the temporary protection from 4 September 2032, or the IND will withdraw these decisions. But, news decisions will follow, ending the temporary protection as of 4 March 2024.
In any way, the Courts and the IND will have to look at the specific circumstances of each case. Therefore, it is our advice to get legal assistance in these cases, to see whether you might still have the right for continuation of your legal stay! For example if you have family life with an Ukrainian citizen.
