mr. Flip Jansen successfully argued before the court in Utrecht that a Schengen visa was wrongly refused by the Dutch embassy. The client wanted to visit her partner in the Netherlands. However, according to the embassy and also the Dutch immigration service (IND), it had not been sufficiently demonstrated that they had a relationship with each other. In addition, it was objected that it had not been sufficiently demonstrated that the client would return to the Gambia in time. The court ruled that the short-stay visa could not have been refused without first hearing the client and her Dutch partner during the complaint procedure. The IND must now look at the case again.
